Use of the Amphibian Report Card website (“ARC site”) is subject to the following terms and conditions. By using the ARC site, including mobile versions and/or features, you acknowledge and agree to these terms and conditions.

Privacy: Please review the ARC site’s Privacy Policy, which also governs your use of the ARC site, to understand applicable practices.

Electronic communications: When you use the ARC site, or send emails or other communications from your computer or mobile device to the ARC site, you consent to receive communications from the ARC site electronically. You agree that all notices, policy updates, disclosures, and other electronic communications from the ARC site satisfy any legal requirement that such communications be in writing.

Intellectual property: All content made available through the ARC site, including but not limited to text, images, logos, maps and software, is the property of the ARC site, or its partner organizations or other contributors, and is protected by United States and international copyright laws.

All trademarked and patented materials that appear on the ARC site are the property of their respective owners, who may or may not be affiliated with the ARC site, the Foundation for the Conservation of Salamanders (FCSal), the Emerging Wildlife Conservation Leaders program, the grantors acknowledged on the ARC site, or other partners, funders, or supporters of the ARC site.

Digital Millennium Copyright Act (DMCA): If at any time you believe that the ARC site or a contributor’s post(s) infringe on your copyright(s), please contact webmaster@amphibianreportcard.org. Consistent with the Digital Millennium Copyright Act (DMCA), ARC site managers will carefully evaluate your notice and remove the relevant material from the ARC site where appropriate. Please note that ARC site managers can only address DMCA notices regarding materials published on the ARC site; the ARC site’s managers do not have control over materials published elsewhere, including websites managed by Amphibian Report Card contributors and users.

Account: You may be required to establish and log in to an ARC site account to use certain website services and functions. You are responsible for all activities that occur under your account. The ARC site’s managers reserve the right to terminate accounts, restrict use, or remove or edit content.

Content: You are invited to post species-specific data, analysis, images, maps, commentary, links, questions and other relevant content, so long as the content is not illegal, defamatory, obscene, or inconsistent with others’ intellectual property rights. Submissions may not include commercial solicitations. Users may not misrepresent their identity. The ARC site and FCSal reserve the right to remove or edit any content that violates these restrictions or is otherwise inconsistent with the ARC site’s purposes.

If you submit report cards or other relevant content to the ARC site, you grant the ARC site and FCSal a nonexclusive right to publish that content on the ARC site without restriction, unless otherwise specified. By submitting content to the ARC site, you affirm that you have the rights to use and publish that content, and that the content is accurate to the best of your knowledge.

Age restrictions: The ARC site is intended to engage a general audience, including anyone who shares an interest in the conservation of amphibian species. However, access to and use of the ARC site is restricted to those age 13 years or older in the United States, and 16 years or older in the European Union. Any person who registers as a user or provides their personal information to the ARC site represents that they are 13 years of age or older (16 years or older in the European Union). The ARC site and its managers do not knowingly collect, use, or share information that could reasonably be used to identify children under age 13 without prior parental consent or consistent with applicable law.
